Recently, the Florida Department of Commerce issued its state Minimum Wage Act poster for the year 2025-2026. Effective September 30th, 2025, the Florida minimum wage increased from $13.00 per hour to $14.00 per hour. Additionally, the tipped minimum wage has increased from $9.98 per hour to $10.98 per hour. Florida employers must replace the 2024 poster with this updated notice and display it in a location where employees can access it during the workday.
What Is Amendment 2, and How Did That Affect Florida’s Minimum Wage and the Minimum Wage Poster?
In 2020, Florida voters narrowly passed Amendment 2, a new piece of legislation that required the state’s minimum wage to increase by $1.00 each year, beginning in September 2022, to reach a state minimum wage of $15.00 per hour by September 2026. Every September thereafter, employers will see an increase in the minimum wage based on inflation, as dictated by the Consumer Price Index.
Due to Amendment 2, the Florida Minimum Wage Act notice has been updated annually since September 2022 to reflect changes to the minimum wage. All employers are required to display the most current poster as soon as it is released.
Additional Information on the Minimum Wage Act Poster
Aside from the information about the minimum wage and tipped minimum wage increases, the notice still includes an unedited section regarding anti-retaliation provisions. As explained on the notice, under the State of Florida Constitution, workers have the right to:
- File a complaint about an employer’s alleged noncompliance with lawful minimum wage requirements.
- Inform any person about an employer’s alleged noncompliance with lawful minimum wage requirements.
- Inform any person of his or her potential rights under Section 24, Article X of the State Constitution, and to assist the individual in asserting such rights.
