Effective January 1st, 2026, all Ohio employers must comply with an increase to the state’s minimum wage rates. The Ohio Department of Commerce recently released a revised labor law poster reflecting changes to the state minimum wage. These mandatory revisions require Ohio employers to update their existing minimum wage labor law posting on or before January 1st, 2026.
What Are the 2026 Ohio Minimum Wage Rates?
On September 30th, 2025, the Ohio Department of Commerce announced the updates for the minimum wage rates, which will go into effect on January 1st, 2026.
Per a press release, the state announced that its minimum wage is scheduled to increase to $11.00 per hour from the current minimum wage of $10.70 per hour for all affected non-tipped employees. Meanwhile, the minimum wage for tipped employees will increase to $5.50 per hour from $5.35 per hour. The new amount of $5.50 is in addition to any tips received.
These adjustments represent a 2.8% increase from the current 2025 rates. The annual change reflects the mandate of the Constitutional Amendment (II-34a), passed by Ohio voters in November 2006. II-34a states that Ohio’s minimum wage must increase on January 1 each year by the rate of inflation.
What Are Ohio’s Labor Law Poster Display Requirements?
Historically, businesses in Ohio were required to display physical copies of labor law posters in the workplace in areas frequented by employees, such as break rooms, hallways, and near employee time clocks. However, on April 22nd, 2025, Ohio Governor Mike DeWine signed state Senate Bill 33 (SB 33) into law.
Under SB 33, Ohio employers could begin to display certain labor law posters digitally instead of physically starting on July 20th, 2025. One of those posters is the state’s Minimum Wage notice. This poster is required for all employers and, under the new law, must be posted either in a conspicuous and accessible area in the workplace or on the company’s intranet or electronic storage location, accessible to all workers.
It is important to reiterate, however, that whether the business decides to physically display the 2026 Minimum Wage Poster or make it available digitally, it must be easily accessible in one of those forms.
