South Dakota 2026 minimum wage labor law poster update

The South Dakota Department of Labor and Regulation has released a new minimum wage poster for 2025. Effective January 1st, 2025, the South Dakota state minimum wage will increase from $11.20 to $11.50 per hour. Employers with tipped employees must pay a cash wage of at least $5.75 per hour. While state regulations do not impose a specific minimum wage posting requirement, South Dakota employers should post the agency’s revised 2025 minimum wage poster on or before the effective date of the mandatory increase to demonstrate compliance with the state’s labor and employment laws.

2025 Minimum Wage Rate in South Dakota

The 2025 South Dakota minimum wage rate reflects a thirty-cent increase from the prior year. Employers who pay a base wage of $11.20 per hour to any of their employees must increase the employee's hourly rate to at least $11.50 by no later than January 1st, 2025. Employers with tipped employees may also need to adjust pay rates before the effective date to ensure an hourly cash wage of no less than $5.75, precisely 50% of the new minimum wage rate.

South Dakota revises its minimum wage rates for non-tipped and tipped employees annually, based on the cost of living as measured by the Consumer Price Index (CPI). The Department of Labor and Regulation announces the annual adjustment in October each year.

Required State and Federal Posters in South Dakota

Unlike the optional state minimum wage notice, both state and federal labor laws require South Dakota employers to comply with specific posting obligations. Employers are responsible for prominently displaying the most current South Dakota labor law posters, which combine all required state and federal notices. These obligations include, but are not limited to, the following:

  • State Unemployment Insurance Notice – Provides information on the South Dakota Reemployment Assistance (RA) law, which provides such assistance to workers who become unemployed or have their working hours reduced below “full-time” status.
  • State Safety Notice – Promotes a “Together Everyone Achieves More” safety message as part of a company safety program.
  • Federal EEOC “Know Your Rights – Workplace Discrimination is Illegal” Notice – Informs employees of their rights under various workplace discrimination laws, including Title VII of the federal Civil Rights Act.
  • Federal OSHA “It’s the Law” Poster – Notifies employees of their right to a safe workplace free from recognized hazards likely to cause injury or death.
  • Federal Minimum Wage / Fair Labor Standards Act Notice – Includes the federal minimum wage rate and provisions relating to overtime, child labor, and nursing mothers.
  • Federal Family and Medical Leave Act Notice – Describes annual leave allotments for employers with 50 or more employees on payroll, state government agencies, and most schools.
  • Federal Employee Polygraph Protection Notice – Explains employee protections from the unlawful use of polygraph and lie detector tests in the workplace.
  • Federal USERRA Rights and Benefits Notice – Informs covered employees and job applicants of their protections under the Uniformed Services Employment and Reemployment Rights Act (USERRA).

Employer Takeaways

South Dakota employers should post the revised 2025 South Dakota Minimum Wage poster on or before the effective date of January 1st, 2025. While not required by law, posting the official notice demonstrates that the employer is committed to following South Dakota's minimum wage requirements. The poster informs employees of the required wage rate and explains the tipped employee wage requirements, which aids employers in demonstrating compliance with state labor law laws.
